1. About these Terms
Wiseguys Hold 'Em (the “Game”) is a play-money Texas Hold'em game that runs as an Activity inside Discord. It is operated by Wiseguys Ltd. (“we”, “us”). By launching or playing the Game you agree to these Terms. If you don't agree, please don't use it.
Your use of Discord is still covered by Discord's own Terms of Service and Community Guidelines, which also apply while you play.
2. Who can play
You must be old enough to use Discord: at least 13, or older if your country requires it. If you are under the age of legal majority where you live, you confirm that a parent or guardian is okay with you using Discord and the Game.
3. Play money only
- All chips and dollar amounts in the Game are play money. They have no cash value and cannot be bought, sold, traded, or redeemed for money, prizes, goods, services, or anything else of value.
- The Game is for entertainment only. There is no real-money gambling, wagering, or purchasing in the Game.
- You may not use the Game to run, promote, or encourage real-money gambling, side bets, or the exchange of chips for money or items.
- Nothing is saved between games. There are no accounts, balances, or rankings. When a table closes, its chips are gone.
4. Tables, hosts and computer players
- Each launched Activity has one table. The first person to join the table becomes its host; if the host leaves, another player takes over.
- The host chooses the blinds and the buy-in and starts the game. The blinds are locked once the game has started. The host can change the buy-in later, which only affects new seats and rebuys.
- The host is a player, not a representative of ours, and cannot change these Terms.
- Some tables may include computer-controlled players (“bots”). They are there to fill seats and are for fun.
5. Your conduct
You agree not to:
- harass, threaten, or abuse other players, including through your Discord name or profile picture;
- cheat, or use exploits, bugs, scripts, bots, or automation to play or to gain an advantage;
- try to see other players' hidden cards, or to disrupt, overload, attack, or reverse engineer the Game or our servers;
- impersonate anyone, or break any law or Discord's rules while using the Game.
We may remove you from a table or block your access at any time, with or without notice, if we believe these Terms are being broken or to protect the Game or other players.
6. Your Discord profile
When you play, other players at your table can see your Discord display name and profile picture. Our Privacy Policy explains what we receive from Discord and how it is used. You are responsible for what your Discord profile shows.
7. Our property, and Discord
The Game, including its code, artwork, and branding, belongs to us or our licensors. We give you a limited, personal, non-exclusive, revocable permission to play it through Discord.
Discord and its logos are trademarks of Discord Inc. Wiseguys Hold 'Em is an independent project and is not affiliated with, sponsored by, or endorsed by Discord.
8. Availability and changes
The Game is free and provided “as is” and “as available”. We may change, pause, or end it at any time. Tables can reset or disconnect without warning (for example during maintenance or an outage), and any chips or hands in progress would be lost.
9. Disclaimer
To the fullest extent permitted by law, we make no promises that the Game will be uninterrupted, error-free, or suitable for any particular purpose, and we disclaim all warranties, express or implied.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of chips, data, or profits, arising from your use of the Game. Our total liability for any claim relating to the Game is limited to US$50. Some places do not allow certain limits, so parts of this section may not apply to you.
11. Ending your use
You can stop at any time by leaving the table, and you can remove the Game's access to your Discord account in Discord under User Settings → Authorized Apps. We may suspend or end your access as described in section 5.
12. Changes to these Terms
We may update these Terms from time to time. The updated version takes effect when it is posted here with a new effective date. If you keep using the Game afterwards, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which we are based, without regard to conflict-of-law rules.
